The new law on mobilization partially takes into account the proposals of “The League of the Strong”

The proposals of the public union “The League of the Strong” were partially taken into account in the new law on mobilization. It is a question of preserving the norm regarding the exemption from mobilization of people who have a wife or husband with disabilities of groups I and II. This was reported by Daria Sydorenko, executive director of “The League of the Strong” public union.

“In a letter to the relevant committee of the Verkhovna Rada, we emphasized that issues related to the rights of people with disabilities require careful study and public consultation. It was important for us to preserve the norms that protect the rights of people with disabilities,” said Daria Sydorenko, executive director of “The League of the Strong” NGO.

The new law “On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration” takes into account some of the proposals of the “League of the Strong” related to Article 23. These are the norms that provide a deferral from mobilization for persons who have a spouse or parents with disabilities of group I or II – without any conditions. 

Most of the proposals concerning guarantees for persons with disabilities and their family members were not taken into account. In particular, the additional conditions that appear for exemption from mobilization for those who have a spouse with a group III disability. Also, proposals to preserve the right to exemption from mobilization for persons who care for people with disabilities and are not family members of the first, second and third degree of kinship were not taken into account.   

As a reminder, the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration” was passed by the Verkhovna Rada on April 11. The law was subsequently signed by President of Ukraine Volodymyr Zelenskyy. It comes into force on May 18, 2024. 

Earlier, the public union “League of the Strong” received many inquiries from members of the community regarding the norms proposed by the draft law on mobilization. The lawyers of the union analyzed the draft law No. 10449 “On Amendments to Certain Legislative Acts of Ukraine on Certain Issues of Military Service, Mobilization and Military Registration” and identified the main points that could lead to violations of the rights of people with disabilities. In February, a letter with proposals was sent to the Verkhovna Rada Committee on Social Policy and Veterans’ Rights Protection.
